These terms govern your use of the Vantage app and the flights you book through it. By requesting a booking or paying a deposit you accept them.
Vantage is a trading name of Parker Aviation Pty Ltd, ABN 47 676 222 834, trading as Fly Vantage.
Who you are contracting with
Vantage arranges your flight. The flight itself is operated by Bekaa Air, who holds the Air Operator's Certificate issued by the Civil Aviation Safety Authority (CASA) and is responsible for the conduct of the flight, the aircraft and the crew.
This means two parties are involved: Vantage, with whom you book and pay, and the operator, who carries you. The operator's own conditions of carriage apply to the flight itself and are available on request.
Nothing in these terms makes Vantage the carrier or the holder of an Air Operator's Certificate.
Booking, deposits and confirmation
A booking made in the app is a request, not a confirmed flight. We take a deposit at the time of the request, refundable under the terms below, and confirm availability with the operator before your booking becomes firm.
If we cannot fulfil your request, your deposit is refunded in full.
The balance is payable 48 hours before departure. We send you a secure payment link when it falls due. Your flight is not confirmed until the deposit is received.
Prices and what is included
Prices shown in the app are in Australian dollars and include GST. The price covers the aircraft, the pilot and the flight described.
Food, wine, tastings and venue activities are not included and are settled directly with the venue on the day, unless the tour says otherwise.
Where a landing or island fee is included, it is shown in your checkout breakdown.
A pickup or drop-off away from your departure airport may change the price. Whatever it is, you see it in full before you book and it never changes afterwards.
Changes and cancellations
If you cancel more than 48 hours before departure, everything you have paid is refunded in full.
The full balance is payable 48 hours before departure.
If you cancel between 24 and 48 hours before departure, the deposit is retained and the balance is refunded. By that point the aircraft is committed and the venue is usually booked in your name.
Within 24 hours of departure there is no refund, and the same applies if you do not arrive. At that point the aircraft, the crew and the venue are committed to you and the day cannot be sold to anybody else.
We would rather move your date than keep your money. Ask us about rescheduling first, and where the aircraft and venue allow it we will simply move the booking at no charge.
If we or the operator cancel for any reason other than your conduct, including weather, you may choose a new date or a full refund of everything paid. No notice period applies to us.
Refunds are returned to the card used to pay, and usually appear within 5 to 10 business days depending on your bank.
Weather, safety and the pilot's authority
The pilot in command has absolute discretion over whether a flight proceeds, and may delay, divert, shorten or cancel it on safety grounds. That decision cannot be overridden by Vantage or by you.
Helicopter flying in South East Queensland is weather-dependent. Cancellations for weather are common and are not a failure of service. You will be offered a new date or a full refund.
Subject to the Australian Consumer Law, we are not liable for consequential costs such as accommodation, connecting travel or event tickets arising from a weather cancellation. Please plan accordingly.
Passengers, weight and baggage
Aircraft have strict weight and balance limits. You must give accurate passenger weights when asked. Inaccurate weights can make a flight unsafe. If a flight cannot depart because the weights given were wrong, there is no refund.
Baggage is limited by space and weight. Declare checked and carry-on items when booking so we can plan the load.
The operator may refuse carriage of any passenger or item on safety grounds, including where a passenger appears affected by alcohol or drugs. Where carriage is refused on those grounds there is no refund.
Sharing your flight
If you open spare seats to other customers, the price you pay is reduced by the proceeds of each seat sold, less the Vantage service fee shown at the time.
Opening seats does not make you an operator, a carrier or a seller of air travel. Vantage and the operator remain responsible for the flight; you are simply sharing the cost of a charter you booked.
Seats are not guaranteed to sell. If none sell, you pay the original price.
A seat bought on someone else's flight is final. Changing your mind is not a cancellation: the flight proceeds and there is no refund. The host's price was reduced the moment that seat sold, and it is not raised again afterwards.
If a seat is ever released outside those terms, the host's price returns to what it was before that seat sold. The flight then proceeds only if the difference is paid, by whoever is willing to pay it. We will always tell you before that happens rather than after.
If the flight itself is cancelled, everyone who bought a seat is refunded in full, and so is the host.
Your account
You are responsible for activity under your account and for keeping access to your email secure, since sign-in uses a one-time code sent there.
Please keep your contact details current. We use them to reach you about flight changes, sometimes at short notice.
Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law, which cannot be excluded.
Where liability can lawfully be limited, Vantage's liability for the services it provides is limited to resupplying them or paying the cost of resupply.
Carriage by air is subject to the operator's liability regime and to the Civil Aviation (Carriers' Liability) Act 1959 (Cth) where it applies.
Vantage holds $20 million public liability insurance with QBE. Bekaa Air, as the operator, holds its own passenger liability insurance.
Changes to these terms
We may update these terms. The version that applies to your booking is the one published when you paid your deposit.
Governing law and contact
These terms are governed by the laws of Queensland, Australia, and you and we submit to the courts of that State.
